No one asked me, but …
My .02 on yesterday’s Ninth Circuit Ruling:
As noted here and also in the WSJ today (sadly behind the paywall), I think this is a incredibly shrewd decision, since it both insulates states who’ve already passed marriage equality laws (Iowa, for example) from referendum rollbacks AND focuses the California issue very narrowly.
I think the latter is more important. Keeping the Supremes as presently constituted away from the broadest arguments in favor of gay marriage (due process, equal protection, generally) gives marriage equality proponents the latitude to bring those claims in the future when there will, hopefully, be a more receptive group on the bench.
To do all of that while still overturning Prop 8 is a pretty impressive feat.
